These Terms of Service ("Terms") are an agreement between you and SunChem LLC, an Arizona, United States company ("SunChem", "we", "us", or "our"). They govern your use of the SunChemApp website, web app, mobile apps, and related services (the "Service"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
SunChemApp provides informational estimates, not professional advice or a safety certification. Doses, treatment plans, chlorine-loss projections, weather and sunlight estimates, water-balance calculations, reminders, warnings, and all other outputs depend on the information you enter, general models, external data, and assumptions that may be incomplete, delayed, or wrong.
SunChemApp does not confirm that water is safe to swim in and is not a substitute for current professional-grade testing or the judgment of a qualified pool professional. Before acting, independently verify pool volume, current readings, product type and strength, equipment, conditions, and the suggested amount.
The manufacturer's product label and applicable law always control over the Service. Pool chemicals can cause serious injury, death, fire, toxic gas, or property damage. Never mix chemicals; never add water to acid; use appropriate protective equipment and ventilation; add products separately and gradually; keep people and pets away as directed; store products securely; and re-test before swimming or adding more. If anything is uncertain, stop and consult the product manufacturer, poison control, emergency services, or a qualified pool professional as appropriate.
Subject to these Terms, SunChem grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful pool-management purposes. SunChem and its licensors retain all rights in the Service, software, design, branding, models, and content other than information you submit.
As between you and SunChem, you retain your rights in pool records, test readings, notes, and other information you submit. You give SunChem a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and adapt that information only as reasonably needed to provide, secure, support, and improve the Service, comply with law, and share it with people you authorize.
You represent that you have the right to submit information to the Service and share it with your organization. Do not submit sensitive personal information that is unnecessary for pool management.

The Service relies on providers such as Replit, Apple, Google, RevenueCat, Stripe, Open-Meteo, BigDataCloud, and mapping services. External data, links, stores, and services are controlled by their providers and may be inaccurate, delayed, unavailable, or subject to separate terms. SunChem is not responsible for third-party services to the extent permitted by law.
We may update, add, remove, limit, suspend, or discontinue Service features. We do not promise uninterrupted availability, permanent storage, compatibility with every device, or that every error will be corrected. Keep independent records of information you cannot afford to lose.
To the maximum extent permitted by law, the Service is provided "as is" and "as available." SunChem disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, safety, availability, and results. We do not warrant any dose, calculation, weather data, prediction, warning, product match, or other output. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
To the maximum extent permitted by law, SunChem and its owners, employees, contractors, affiliates, and suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, data, use, or goodwill; substitute services; or property damage, personal injury, illness, or death arising from or related to the Service, pool conditions, chemical handling, or decisions based on Service output, even if advised of the possibility.
To the maximum extent permitted by law, the total aggregate liability of SunChem and the parties listed above for all claims related to the Service will not exceed the greater of (a) US $100 or (b) the amount you paid SunChem for the Service during the twelve months before the event giving rise to the claim. These limits do not apply to liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SunChem and its owners, employees, contractors, affiliates, and suppliers from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the Service, your violation of these Terms, or information you submit without the necessary rights. This section does not require indemnification for SunChem's own negligence or misconduct where prohibited by law.
You may stop using the Service at any time and may request account deletion through Settings, subject to team-owner protections. We may suspend or terminate access to protect users or the Service, comply with law, address nonpayment, or respond to a material or repeated violation of these Terms. Where reasonable, we will provide notice or an opportunity to fix the issue.
We may update these Terms as the Service or law changes. We will post the updated Terms and change the date above. For material changes, we will provide additional notice when required. Changes apply prospectively from their effective date. Continued use after that date constitutes acceptance where permitted by law.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your place of residence continue to apply where they cannot be waived. Nothing in these Terms limits rights or remedies that applicable law does not permit you to waive.
These Terms and the Privacy Policy are the entire agreement between you and SunChem concerning the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A waiver must be in writing and is not a continuing waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of the Service. Section headings are for convenience only. Provisions that by their nature should survive termination will survive.
